Welcome to WindSailing (“we”, “us”, “our”). These Terms & Conditions explain the rules for using our website and the general terms that apply when you request a quote and make a booking.

Important: Yacht charters are ultimately governed by the Booking Confirmation / Quote and the Charter Party for the specific yacht. The Charter Party is provided during the booking process and can be requested in advance at any time. If anything in these Terms conflicts with the Charter Party, the Charter Party prevails.

1) Company details (Operator / Contracting party)

WindSailing is a trade/brand name used by the following legal entities (each owning/operating a specific yacht):

Contracting party: Your booking contract is with the relevant company stated on your Quote / Booking Confirmation and Charter Party for the yacht you book.

2) Definitions

  • Charterer / You: the person making the booking and responsible for the charter party.
  • Guests: all persons on board during the charter.
  • Yacht / Vessel: the yacht specified in your Quote / Booking Confirmation (e.g., Kyknos or Zoe).
  • Charter Period: the dates and times stated in the Booking Confirmation / Charter Party.
  • Skipper/Captain: the person in command of the yacht (either appointed by us for skippered charters or provided by the Charterer for bareboat).
  • Force Majeure: events beyond reasonable control (e.g., severe weather, Port Authority restrictions, strikes, natural disasters, etc.).

3) Website use

You may use this website for lawful purposes only. You agree not to misuse forms (spam/abuse), attempt unauthorized access, upload malware, or infringe rights. We may update or withdraw parts of the site at any time.

4) Enquiries, quotes, and booking confirmation

Submitting an enquiry does not create a binding booking. A booking is confirmed only when we issue written confirmation via Quote / Booking Confirmation (and where applicable the Charter Party is signed) and the required payment is received. Availability can change until confirmation.

5) Prices, inclusions, and exclusions

Prices and what’s included/excluded are specified in your Quote / Booking Confirmation and/or Charter Party. Discounts apply only if explicitly stated in writing.

Unless your Quote / Booking Confirmation states otherwise, typical items that may be excluded include (non-exhaustive): fuel, marina/port fees, provisioning/food & beverages, transfers, crew gratuities, and optional extras (e.g., water toys, SUP, early check-in/late check-out, one-way fees). The exact inclusions/exclusions for your charter are those listed in your Quote / Booking Confirmation.

6) Payments

  • Advance payment: 40% of the charter fee is due within 15 days from Booking Confirmation. If no payment is received by then, the booking is considered cancelled.
  • Balance payment: the remaining 60% is due 1 month before embarkation.

Unless your Booking Confirmation explicitly states different deadlines, the above applies.

7) Security deposit and damage responsibility

A refundable security deposit may be required (especially for bareboat) before embarkation, used to cover loss/damage, missing equipment, or other chargeable incidents (as stated in your booking documents).

The Charterer is financially responsible for loss/damage caused by the Charterer/guests (misuse, negligence, missing equipment, excessive cleaning), regardless of whether a professional skipper is onboard.

8) Changes requested by the Charterer

Change requests (dates, yacht, guest list, base, etc.) are subject to availability and may involve price differences. Any change is valid only once confirmed by us in writing.

9) Cancellation & rebooking (Charterer)

If the Charterer cancels after Booking Confirmation:

  • More than 30 days before embarkation: cancellation fee is 40% of the final price (the advance payment is non-refundable).
  • 30 days or less before embarkation: cancellation fee is 100% of the final price (full payment is retained / becomes due).

Rebooking option (instead of cancellation): If the Charterer requests to move the charter to a different period under the same conditions and subject to availability, we may offer rebooking. If rebooking is accepted and completed, no cancellation fees apply.

Official travel restrictions: If official restrictions make it objectively impossible to travel to Greece for the charter period (e.g., government flight bans/border closures), we may offer rebooking under the same conditions, subject to availability. Otherwise, the cancellation terms above apply.

10) Cancellation or changes by us

We may cancel or change arrangements due to safety, serious technical failure, Port Authority restrictions, or Force Majeure. In such cases, we will try to offer a comparable yacht (subject to availability), rescheduling, or refund in line with the Charter Party terms.

11) Weather, safety, and skipper authority

The sea is a safety-critical environment. The Captain/Skipper may restrict itinerary, sailing times, swimming activities, or passenger conduct due to weather, safety, or official instructions. Safety decisions do not automatically entitle refunds.

12) Check-in / check-out and late return

Embarkation/disembarkation times are as stated in your Booking Confirmation / Charter Party. Late return may result in additional charges.

13) Guest obligations and bareboat requirements

You and your guests agree to comply with Greek law and all instructions from Port Authorities and the Captain/Skipper, and to treat the yacht/equipment with care.

Bareboat (self-sail): the Charterer must provide a qualified skipper with valid sailing credentials and adequate experience for the vessel and area. We may request evidence of qualifications and may require a competence check. If competence is not satisfactory, we may require a skipper to be placed onboard at the Charterer’s expense (subject to availability) or terminate the charter according to the Charter Party.

14) Health and personal responsibility

Chartering involves inherent risks. You are responsible for ensuring fitness to travel/sail and ensuring minors are supervised.

15) Insurance, deductible/excess, and limitation of liability

The yacht is insured as described in the Charter Party/booking documents. The Charterer remains responsible for:

  • the insurance deductible/excess (where applicable),
  • loss/damage not covered by insurance, and
  • loss/damage caused by gross negligence or wilful misconduct of the Charterer/guests.

To the extent permitted by law, we are not liable for indirect or consequential losses (missed flights, accommodation, etc.). Nothing in these Terms limits liability that cannot be limited under applicable law.

16) No right of withdrawal for specific-date charters

Because yacht charters are leisure services provided for a specific date or period, the statutory 14-day right of withdrawal for distance contracts does not apply to the charter service to the extent permitted by law. Cancellations are handled under Section 9 above.

17) Complaints, onboard issues & damage reporting

If any issue arises during the charter, the Charterer must notify us as soon as possible so we can attempt to resolve it. Complaints raised only after check-out may be harder to verify and may be assessed accordingly, especially where the issue could reasonably have been corrected during the charter.

The Charterer must report any damage, malfunction, or incident immediately. Where required, the Charterer must request the nearest Port Authority to record the incident and notify us without delay.

18) Intellectual property

All website content (text, photos, branding, logos) is owned by WindSailing or used under license. You may not reuse it commercially without written permission.

19) Privacy & cookies

Your use of our website and forms is also governed by our Privacy Policy and Cookie Policy.

20) Governing law and jurisdiction

These Terms are governed by the laws of Greece. Any disputes are subject to the competent Greek courts, unless mandatory consumer protections provide otherwise.
